TERMS & CONDITIONS

(a) This Agreement is between Alexander Beal Pty Ltd (ABN [Insert ABN if applicable]) (“we”, “our” or “us”) and you (“you” or “Customer”), the individual or entity purchasing any of our Products, Services, or On Demand Products (collectively “Products”) from our website at www.alexanderbeal.com (“Site”).

(b) By purchasing any Products from us or proceeding with any quote issued, you confirm that:

(i) You have read, understood, and accepted these Terms & Conditions (“Terms”); and

(ii) You have the legal capacity to enter into a binding agreement with us.

(c) You must be at least 18 years old to place an order or register an account.

(a) You may create an account (“Account”) to purchase Products from our Site. While you may purchase without an Account, certain features (such as monthly billing and order tracking) require you to register.

(b) You agree to provide accurate, current, and complete information when creating an Account and to update such information as necessary.

(c) You are solely responsible for all activity that occurs under your Account.

(a) When you place an Order for any of our Products or On Demand Products (including training programs, digital downloads, or coaching services), your Order is considered an offer to purchase at the price indicated at the time of ordering.

(b) We reserve the right to accept or reject any Order at our discretion. If an Order is accepted, a separate binding contract between you and us is formed.

(c) It is your responsibility to ensure the accuracy of your Order details prior to submission.

(a) The Price for each Product is as stated on the Site in British Pounds/Australian dollars and includes applicable GST, unless stated otherwise.

(b) Payment is due at the time of purchase unless you have an Account with us, in which case payment may be structured on a recurring monthly basis as outlined during registration.

​

(c) You warrant that any payment details provided are accurate and that you are authorised to use the chosen payment method.

​

(d) If payment is not received as agreed, we reserve the right to suspend or cancel your access to the Products until payment is made.

(a) All Products are subject to availability. We make every effort to keep our digital and on-demand products up-to-date; however, we reserve the right to modify, suspend, or discontinue any Product at any time without notice.

(b) For subscription-based coaching or digital Product services (including On Demand Training Programs), a minimum commitment period (e.g. 12 weeks) may apply as detailed in the specific product description.

(c) Cancellation or termination of subscription-bas

ed services must be made in writing (via email to fitness@alexanderbeal.com) and may be subject to a notice period as specified in the product description.

(d) Refunds for digital or on-demand Products are generally not available once the Product has been accessed, except where required by applicable law.

(a) Products purchased on our Site, including On Demand Training Programs and digital downloads, will be delivered electronically or made accessible via your Account on the Site.

(b) You are responsible for ensuring that your provided email address or other contact details are correct to receive delivery notifications and access instructions.

(a) All content, designs, and materials provided on the Site and within our Products remain the intellectual property of Alexander Beal Pty Ltd unless otherwise stated.

(b) You may use the content solely for personal, non-commercial purposes. Any unauthorised use, reproduction, or distribution is prohibited.

(a) To the maximum extent permitted by law, our total liability arising under or in connection with these Terms or any Products will not exceed the amount paid by you for the relevant Product.

(b) We are not liable for any indirect, incidental, or consequential loss or damage arising from the use of, or inability to use, our Products.

(a) We collect and use your personal information in accordance with our Privacy Policy, which is incorporated by reference into these Terms.

(b) By using our Site and purchasing our Products, you consent to the collection, storage, and processing of your personal data as described in our Privacy Policy.

(a) Disputes: Any disputes arising under these Terms must first be attempted to be resolved through good faith negotiations.

(b) Notices: All notices or communications must be sent via email or post to the contact details provided on our Site.

​

(c) Waiver: Any failure to enforce any right under these Terms shall not be deemed a waiver of that right.

(d) Severability: If any provision of these Terms is held invalid, the remainder shall continue in full force and effect.

(e) Entire Agreement: These Terms constitute the entire agreement between you and us regarding the subject matter herein.

(f) Governing Law: These Terms are governed by the laws of London, United Kingdom. You agree to submit to the exclusive jurisdiction of the courts in the United Kingdom for any disputes arising out of these Terms.
